GENERAL TERMS AND CONDITIONS

1. Purpose and Scope of Application
1.1 These General Terms and Conditions govern all contractual relationships between Torres de Selma SL (hereinafter, “TDS”) and the client.
1.2 These terms apply to all stays, treatments, events, retreats, and other services offered by TDS, whether directly or through authorised third parties.
1.3 These conditions form an integral part of every contract entered into between TDS and the client.
1.4 TDS may amend these terms, which shall apply exclusively to new reservations made after their publication.
2. Definitions
Client: Natural or legal person who books a stay, treatment, or event with TDS.
Contract: Agreement entered into between TDS and the client by written, electronic, or exceptionally telephone confirmation.
Event / Retreat: Course, training, seminar, workshop, or other organised activity.
Package Price: Total amount payable for the contracted services.
Stay: The client’s physical presence at TDS facilities.
Ayurvedic Treatment: Complementary wellness therapy that does not replace conventional medicine.
3. Resort Rules and Admission
3.1 The resort is 100% smoke-free. Only vegetarian food is served.
3.2 The minimum age for accommodation is 18. Minors may only access the resort when accompanied by a parent or legal guardian.
3.3 Due to the historic nature of the buildings and the terrain, the resort is not accessible to wheelchair users.
3.4 The maximum number of occupants per room is strictly limited.
3.5 The client undertakes to respect internal rules and reasonable instructions given by TDS staff.
3.6 In the event of inappropriate behaviour or serious breach, TDS may cancel the stay immediately, without entitlement to a refund.
4. Services and Packages
4.1 TDS offers:
a) Accommodation packages (Bed & Breakfast, minimum two nights);
b) Event and retreat packages;
c) Ayurvedic treatment packages (available from mid-2026).
4.2 Content, availability, and prices are detailed at www.torresdeselma.com.
5. Reservations and Payments
5.1 All reservations must be made in advance.
5.2 A reservation is only considered confirmed after written confirmation by TDS and receipt of the corresponding payment.
5.3 Payment must be made within the period indicated in the confirmation. For arrivals within less than 7 days, payment is due immediately.
5.4 Failure to make payment within the established period will result in automatic cancellation of the reservation.
6. Cancellations
6.1 Cancellation by the client:
a) More than 30 days before arrival: 100% refund
b) Between 30 and 10 days before arrival: 50% refund
c) Less than 10 days before arrival: no refund, unless the service is resold to a third party
6.2 Exclusive events and retreats
a) The 50% paid as a deposit constitutes reservation and exclusivity costs and is non-refundable.
b) The remaining 50% must be paid 60 days before the start of the event.
6.3 In exceptional cases, TDS may allow a change of dates, applying amounts already paid to the new date.
7. Arrival and Departure
7.1 Check-in (B&B): from 15:00 to 18:00
7.2 Check-out: 10:00
7.3 Late check-out is subject to availability and additional charges.
7.4 The check-in and check-out times are agreed upon in the retreat agreement.
8 Prices and Taxes
8.1 All prices include VAT unless expressly stated otherwise, like tourist taxes.
8.2 Changes in taxes or fees do not entitle the client to terminate the contract free of charge.
8.3 Prices do not include transportation to the resort unless otherwise stated.
9. Force Majeure and Modifications
9.1 TDS shall not be liable for non-performance due to force majeure, including but not limited to pandemics, natural disasters, or governmental restrictions.
9.2 TDS may modify or cancel events for justified reasons. In such cases, the client shall be entitled to:
a) a full refund, or
b) rescheduling, by mutual agreement.
10. Liability
10.1 Nothing in these terms excludes or limits TDS’s liability for personal injury or death caused by negligence, or any liability that cannot be legally excluded.
10.2 TDS shall not be liable for losses, thefts, or damages resulting from the client’s negligence or causes beyond its control.
10.3 Ayurvedic treatments are complementary and do not replace medical treatment. The client is responsible for consulting healthcare professionals.
11. Complaints
11.1 Complaints must be communicated as soon as possible during the stay.
11.2 Written complaints must be submitted within 7 days after the service.
11.3 TDS will respond within a maximum period of one month.
12. Data Protection
12.1 Personal data will be processed in accordance with the General Data Protection Regulation (GDPR).
12.2 The sending off commercial communications requires the client’s express consent.
13. Images and Recordings
13.1 TDS may use images from events for promotional purposes only with the client’s express consent.
13.2 Recordings made during treatments will be strictly confidential.
14. Intellectual Property
All materials provided by TDS are protected by intellectual property rights and may not be reproduced without written authorization.
15. Applicable Law and Jurisdiction
15.1 This contract is governed by Spanish law.
15.2 All disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the court located within the jurisdiction of TDS.
